Your workforce, described properly
Insurers write EPL from what they’re told: which entities employ people, where those people work, and whether you use contractors or temporary staff. Planned hiring, layoffs, an acquisition, or a change in leadership all matter.
We help you describe this accurately, and we check who is insured and who can bring a claim under the policy. Claims from people who aren’t employees, such as clients alleging harassment, are called third-party claims, and they aren’t always included.
Who picks the lawyer and who decides to settle
Some EPL policies require you to use the insurer’s approved law firms, and most need the insurer’s consent before you spend money or settle. If you have employment counsel you’d want to use, tell us and we’ll raise it with insurers before you buy.
Reporting early matters. A demand letter or an agency charge may already count as a claim under the policy, so waiting for a lawsuit can be too late. We tell you what your policy treats as a claim and how to report one.
What EPL usually leaves out
Wage-and-hour claims, such as unpaid overtime, are the gap we ask about first. Policies often exclude them or offer only a small amount for legal fees. Contract disputes and benefits disputes are commonly excluded too, even when they show up alongside a covered claim.
If EPL is part of a package with D&O or other coverage, one employment claim could reduce what’s left for anything else. For each quote, we set out:
- Which entities and types of workers are included
- Whether claims from non-employees are covered
- What counts toward the retention and the limit
- Any wage-and-hour coverage, and how much
